| ???metadata.dc.description.resumo???: | O presente trabalho versa sobre a possibilidade jurídica da aplicação da Lei nº 13.104/2015 - Lei do Feminicídio – para as mulheres Trans*, num contexto de violência de gênero. O relatório do Mapa dos assassinatos de travestis e transexuais no Brasil em 2017, publicado pela Associação Nacional de Travestis e Transexuais (ANTRA), revela que está instalada no país uma realidade de transfobia e transfeminicídio. Desde modo, tomando como ponto de partida a teoria da performatividade de Judith Butler, as indagações de Berenice Bento acerca da patologização das identidades Trans*, bem como a defesa dos direitos da causa LGBTI da jurista Maria Berenice Dias, esta pesquisa objetiva uma desconstrução de termos pré-concebidos por uma sociedade heteronormativa, sexista e misógina. Em uma síntese análise do “Caso Dandara” foi possível observar o quanto é impreterível a aplicação da respectiva Lei às mulheres Trans*. Vale ressaltar que essa discussão aborda como mulher qualquer sujeito que se identifique de tal forma, ultrapassando as limitações binárias acerca de sexo biológico e adentrando em discussões de gênero, identidade de gênero e diversidade sexual, numa perspectiva de (des) construções culturais. |
| Abstract: | This undergraduate thesis deals with the legal possibility of applying Law no. 13.104 / 2015 - Law of Feminicide - for Trans women*, in a context of gender violence. The report of the Map of Transvestite and Transsexual Murders in Brazil in 2017, published by the National Association of Transvestite and Transsexuals (ANTRA), reveals that a reality of transphobia and transfeminicide is taking place in the country. This way, taking as a starting point Judith Butler's theory of performativity, Berenice Bento's inquiries about the pathologization of Trans* identities, as well as the defense of the rights of the LGBTI cause of the jurist Maria Berenice Dias, this research aims a deconstruction of terms conceived by a heteronormative, sexist and misogynist society. In a synthesis analysis of the "Dandara Case" it was possible to observe how much the application of the respective Law to Trans women* is essential. It is worth emphasizing that this discussion addresses as a woman any subject that identifies itself in such a way, overcoming binary limitations on biological sex and entering into discussions of gender, gender identity and sexual diversity, in a perspective of cultural (des) constructions. |
