dc.description.resumo	A temática a ser desenvolvida na presente monografia tem como escopo demonstrar a partir de um ponto de vista crítico os aspectos éticos e jurídicos dos efeitos do insti- tuto na união estável sobre o reconhecimento da filiação advinda da reprodução hu- mana assistida post mortem, evidenciando a equiparação da união estável com o ca- samento, para fins de reconhecimento dessa filiação. Assim, partindo de uma teoria argumentada e fundamentada procura-se compreender o tema com uma explanação dos conceitos e principais institutos que a circundam e se mostram de grande impor- tância para uma melhor abordagem do assunto em epígrafe, como os principais as- pectos ligados a família, que é tida como a base de todo aparelhamento social, for- mada por pessoas ligadas por relações de parentesco ou por laços afetivos, sendo que, esse conceito se mostra cada dia mais mutável seguindo as evoluções das rela- ções sociais, evidenciando ainda os princípios que norteiam as relações familiares e demais institutos ligados ao Direito de Família. Traça-se também os principais con- tornos da filiação, bem como o exercício do poder familiar que caminha de mãos da- das com aquela, evidenciando ainda os aspectos relativos a reprodução humana as- sistida, que também proporcionou uma nova visão aos pilares da filiação para que estes passassem a ser ponderados com o intuito de atender tanto a concretização do projeto parental da sociedade, como também garantir o melhor interesse dos filhos gerados por meios dessas técnicas. Além disso, ressalta-se ainda os contornos da reprodução humana assistida no ordenamento jurídico brasileiro, dando enfoque na reprodução humana assistida homóloga post mortem, que é aquela realizada após a morte do cônjuge varão, além de edificar um posicionamento argumentativo sobre o instituto da união estável e os efeitos da mesma incidentes no reconhecimento da filiação advinda da reprodução humana assistida post mortem no ordenamento jurídico brasileiro. Utiliza-se no referenciado trabalho como técnica de pesquisa a bibliográfica, sendo também empregada o método histórico, como método de procedimento. O método de abordagem será o dedutivo, partindo de formulações gerais para que se possa centrar no tema abordado.	pt_BR

dc.description.abstract	The theme to be developed in this monograph is to demonstrate, from a critical point of view, the ethical and legal aspects of the effects of inscription in an instant on the recognition of the affiliation coming from the assisted human reproduction post mor- tem, evidencing an equation of the stable union with the marriage, for the purpose of recognition of this affiliation.
