| ???metadata.dc.description.resumo???: | O presente trabalho, utilizando o método dedutivo e a técnica bibliográfico busca analisar a utilização do equivalente jurisdicional mediação, como meio eficiente para dirimir conflitos ambientais, tendo em vista a busca da efetivação tanto da garantia constitucional em ter um meio ambiente saudável, quanto a de dar uma melhor prestação jurisdicional frente a garantia dada pelo direito fundamental da razoável duração do processo, no entanto sem abrir mão do bem ambiental. No decorrer do trabalho analisou-se no primeiro momento o instituto da mediação e posteriormente o bem ambiental, e no final a utilização da mediação nos conflitos que tem como interesse de agir a proteção e/ou recuperação do bem ambiental. Por fim, encontrou-se tanto embasamento legal, quanto julgados e exemplos no ordenamento jurídico pátrio, que demonstra ser possível a utilização da mediação com forma possível de dirimir conflitos ambientais, no entanto, sem esse abrir mão do bem ambiental. |
| Abstract: | This study, using the deductive method and bibliographic technique seeks to analyze the use of the judicial equivalent mediation as an efficient means to resolve environmental conflicts, in order to search the effectiveness of both the constitutional guarantee of having a healthy environment, as the give a better adjudication against assurance of the fundamental right of reasonable duration of the process, but without giving up the environmental well. During the work analyzed at first the mediation institute and subsequently the environmental good, and end the use of mediation in conflicts whose interest to act in protection and / or recovery of environmental good. Finally, he met both legal foundation, as judged and examples in the Brazilian legal system, which proves to be possible to use mediation as possible to resolve environmental conflicts, however, without this giving up the environmental well. |
