Direito animal: uma abordagem acerca da leishmaniose canina.

Abstract

The Environmental Law has been having a strong focus on the world stage, despite that, the evolution in this field is still being slow, specially about the animal rights. Observed this, a bibliographic research was conducted, tracing a brief history of the animal rights, observing discussions about the conception of animals like subjects of law and, finally, proceeding with the study in the ambit of Brazilian Law, about how the animals rights has been applied, specifically related to the Public Policies and legislations related to Canine Leishmaniosis. With this study, is possible to understand that animal rights, as the other rights, is passing through modifications, and the theories about the acceptance of animals as subjects of law has been adopted in some countries, and that the countries which didn‟t accept this concept yet, ending, somehow, including the animals into their legislation; finally, facing this study, are undeniable the loopholes and deficiencies of the Brazilian legislation regarding the protection of animals and, mainly, the effectiveness of the control of leishmaniosis in Brazil; it was seen that this will only be resolved if the various actors involved creating debate forums for discussion, in which various segments of civil society organizations and public institutions can dialectically express their ideas, disagreements, compromises and challenges about possible solutions for the clash, searching for a better dialogue, leading to practices based on scientific evidence rather than mere electioneering policies and actions.
