dc.description.resumo	O presente trabalho monográfico busca demonstrar que o parto anônimo surge como uma solução ao abandono trágico de recém-nascidos, pois afasta a clandestinidade do abandono, evitando, consequentemente, as situações indignas nas quais os recém-nascidos são deixados. Há a substituição do abandono pela entrega. A criança é entregue em segurança a hospitais que irão cuidar de sua saúde e em seguida irá encaminhá-la à adoção, assegurando a potencial chance de convivência em família substituta. Por sua vez, a mãe terá assegurada a liberdade de abrir mão da maternidade sem ser condenada, civil ou penalmente, por sua conduta. O objetivo não é esconder a maternidade socialmente rejeitada, mas garantir a liberdade à mulher de ser, ou não, mãe do filho que gerou, com amplo acesso à rede pública de saúde. As crianças terão, a partir de então, resguardados o seu direito à vida, à saúde e a integridade e potencializado o direito à convivência familiar. A legalização do Parto Anônimo tornaria o processo de adoção mais célere o que, consequentemente, diminuiria o índice de crianças expostas à mortalidade e abandono. Afinal, se colocado numa balança o direito à vida e a identidade do nascituro, o primeiro, inquestionavelmente, deverá preponderar, tendo em vista que a afetividade se sobrepõe ao critério biológico; a oposição ao parto anônimo, em virtude de uma possível mitigação do direito à identidade, é uma atitude inaceitável. Desta forma, pode-se dizer que o objetivo deste trabalho é estudar o Parto Anônimo, analisando sua aplicabilidade no processo de adoção. Abordando desde os primórdios do Parto Anônimo no Brasil e no mundo nas chamadas Rodas dos Expostos, o processo de adoção no país, até o conteúdo e propósitos dos Projetos de Lei que versam sobre o tema apresentado. Para atender ao propósito desta monografia, optou-se pela pesquisa bibliográfica e histórica. Como resultado desta pesquisa, vislumbrou-se que, pondo em prática o Parto Anônimo no ordenamento pátrio, estar-se-ia garantindo o direito à vida, à liberdade, à convivência familiar efetiva e preservando a integridade da criança por meio do principio da dignidade da pessoa humana.	pt_BR

dc.description.abstract	This monograph seeks to show that the anonymous delivery comes as a solution to the tragic abandonment of newborns, because away underground abandonment, avoiding hence inhumane situations in which newborns are left. There replacing the abandonment for delivery. The child is delivered safely to hospitals who take care of their health and then will forward it to the adoption, ensuring the potential chance of living in a foster family. In turn, the mother will have guaranteed the freedom of open maternity hand without being convicted, civil or criminal, for his conduct. The goal is not to hide the socially rejected motherhood, but guarantee the freedom of women to be or not child's mother who bore with broad access to public health. Children will, thereafter, safeguarded their right to life, health and integrity and enhanced the right to family life. The legalization of Anonymous Childbirth become the most expeditious adoption process which, in turn, would reduce the number of children exposed to death and abandonment. After all, if we put in the balance the right to life and the identity of the unborn child, the first unquestionably should prevail, given that affection overrides the biological criteria; opposition to anonymous childbirth, due to a possible mitigation of the right to identity, is an unacceptable attitude. Thus, it can be said that the goal of this study is on the Anonymous Childbirth, analyzing its applicability in the adoption process. Addressing since the beginning of Anonymous Childbirth in Brazil and in the world in so-called Wheels of Exposed, the adoption process in the country, to the content and purpose of the Bills that deal with the theme presented. To meet the purpose of this monograph, it was decided to literature and historical research. As a result of this research, it is envisioned that by implementing the Anonymous Childbirth in parental planning, we would be guaranteeing the right to life, liberty, and effective family life and preserving the integrity of the child through the principle of human dignity.	pt_BR
