| ???metadata.dc.description.resumo???: | Este presente trabalho possui a finalidade de analisar os principais aspectos jurídicos da guarda compartilhada e demonstrar que decorrente da atual evolução social é a modalidade que mais atende aos interesses do menor, uma vez que enseja dar continuidade a autoridade parental de forma igualitária, preservando as relações entre pais e filhos mesmo após a dissolução da sociedade conjugal e consequentemente diminuindo os efeitos dolorosos que a separação provoca. Analisei as características e a evolução do poder familiar, no Direito Brasileiro e comparado, pois a guarda está vinculada diretamente ao respectivo instituto. Analisei as principais modalidades de guarda, com o objetivo de comparar e atestar que na maioria dos casos a aplicação da guarda compartilhada é a melhor solução. Foram utilizadas como referências bibliografias para composição e enriquecimento desse trabalho, a Constituição Federal de 1988, o Código Civil, o Estatuto da Criança e Adolescente, como também diversas doutrinas especializadas. |
| Abstract: | This present work has the purpose to explain the main aspects of shared custody and show that due to the current social evolution is the mode that best meets the child's interests, since it entails continuing parental authority equally, preserving the relationships between parents and children even after the dissolution of marriage and consequently decreasing the painful effects of separation. It is examined the characteristics and evolution of the familiar power, under Brazilian and in comparative law, because the guard is linked directly to the respective institute. It was studied the main guard modalities, with the goal to compare and attest that in most cases the application of shared custody is the best solution. Were used as references for composition and enrichment of this work, the Federal Constitution of 1988, the Civil Code of 2002, the Statute of Children and Adolescents, as well as various specialized doctrines. |
