| ???metadata.dc.description.resumo???: | O presente trabalho objetiva estudar o abandono afetivo parental, suas consequências e seus danos, além de mostrar de forma clara e concisa a possibilidade de se responsabilizar os genitores omissos por não cumprirem com seu dever legal gerando um ato ilícito indenizável. Propõe-se que a partir de uma analise histórica sobre a família e seu atual patamar no direito pátrio demonstrar o valor jurídico do afeto e desmistificar o afeto como um simples sentimento. Começando com a analise da família seu histórico e evolução de forma geral e no Brasil, apontando a revolução que foi a Constituição Federal de 88 e os principio que esta trouxe ao direito de família. Também se aborda a responsabilidade civil de forma rápida e clara para o tema. Dando continuidade é estudado o abandono afetivo, o dano por ele causado, suas consequências e o que uma sentença de indenizatória traz além do monetário. Por fim se analisa a jurisprudência pátria e as propostas legislativas sobre o assunto. O método de abordagem utilizado foi o Dedutivo, que consiste na descoberta de uma verdade a partir de outras verdades que já se conhece. Parte do geral para o particular. A Pesquisa é secundária e a técnica de pesquisa foi a bibliográfica. |
| Abstract: | This work aims to study the parental affective abandon, their consequences and their damage and to show clearly and concisely the possibility of blaming the missing parents for not fulfilling their legal duty generating a compensable tort. It is proposed that from a historical analysis about the family and its current level in the parental right to demonstrate the legal value of affection and demystify the affection as a mere sentiment. Starting with the analysis of the family and its historical evolution in general and in Brazil, pointing to the revolution that was the Federal Constitution of 88 and that this principle brought to family law. Also addresses the liability quickly and clearly to the theme. Continuing the emotional distance is studied, the damage caused by it, and its consequences as a judgment for damages beyond the money brings . Finally we analyze the homeland jurisprudence and legislative proposals on the subject. The method used was deductive approach, which consists in discovering a truth from other truths already known. From the general to the particular. Research is secondary and technical research was a literature. |
