| ???metadata.dc.description.resumo???: | O Conselho Tutelar é órgão permanente e autônomo, não jurisdicional, encarregado de zelar pelo cumprimento e defesa dos direitos da criança e do adolescente, segundo o art. 131, do Estatuto da Criança e do Adolescente-ECA. A importância atribuída a este órgão no cuidado e na proteção daqueles menores de 18 anos requereu mudanças na sua estrutura, para melhor atuar na defesa dos direitos menoristas, que estão norteando as discussões atuais. Assim, objetivando analisar as mudanças advindas da Lei n. 12696/2012, este trabalho tem como problemática fazer um paralelo entre as antigas e as novas regras, inseridas no ECA, a respeito do Conselho Tutelar. Para tanto, dividiu-se o estudo em três capítulos: Iniciando, no primeiro momento com um resgate histórico a respeito dos direitos da criança e do adolescente e perpassando por princípios para ratificar a idéia de proteção; seguindo com a estrutura e configuração do Conselho Tutelar, antes e após as inovações, tentando fazer um diagnóstico do perfil deste Conselho, as quais são expostas no ultimo capítulo do trabalho, que faz um apanhado da Lei n. 12.696/2012, pontuando de forma mais especifica as inovações que coadunam para uma melhoria no funcionamento e na formação estrutural do Conselho Tutelar. Neste trabalho utilizou-se o método dedutivo de pesquisa, para um estudo qualitativo, baseado em uma analise da legislação. |
| Abstract: | The Conselho Tutelar is a permanent, autonomous and not judiciary organ of the government responsible for ensuring compliance and defense of both child and adolescent rights, according to the article 131 of the Statute of the Child and the Adolescent - ECA. The significance assigned to this organ concerning care and protection of the ones younger than 18 years old has required structural changes for a better defense of their rights. Aiming to analyze the changes arising from the Law number 12696/2012, this work has the objective of comparing the old and the new rules inserted on ECA. To do so, the study was sectioned in three chapters, the beginning concerns about the history behind the child and adolescent rights. The following is about the configuration and structure of Conselho Tutelar, before and after the innovations, which are exposed in the last chapter, where the Law number 12696 is analyzed focusing on the innovations that improves the operation and structural formation of the Conselho Tutelar. |
