| ???metadata.dc.description.resumo???: | O presente trabalho trata dos motivos e da importância de se priorizar a ligação afetiva já existente entre adotante e adotando em face da rígida observância da obrigatoriedade de inscrição no cadastro de adoção trazido pela Lei 12.010 de 2009 como forma de se garantir o direito a convivência familiar e a prioridade dos interesses da criança e do adolescente. Justifica-se o tema pelo aspecto excepcional que é tratada a adoção, assim como a necessidade de mostrar a controvérsia que há de por um lado o Estado garantir o direito à convivência familiar face o princípio da afetividade e de outro a obediência de requisitos estabelecidos pela lei. Busca de forma ampla apontar os argumentos que justificam a prioridade do vínculo afetivo já existente entre o pretendente à adoção e o adotante em detrimento do cadastro instituído pela Lei 12.010 de 2009 e mais especificamente fazer uma análise crítica da lei e os motivos que justificam a criação do referido cadastro, demonstrando as consequências jurídicas e psicológicas da estrita observância. O trabalho foi desenvolvido a partir do método dedutivo, onde a partir de uma ideia geral se chega a uma conclusão em particular, utilizando-se do método histórico e comparativo, através da documentação indireta, referente à pesquisa bibliográfica. Em primeiro momento procura demonstrar toda a evolução do instituto, desde a Antiguidade até o presente momento, evidenciando a evolução de seu conceito e natureza jurídica, de acordo com os princípios informadores do Direito de Família. Logo após se evidencia o tratamento que recebe da legislação pátria, com seus caracteres e requisitos impostos para sua concessão, assim como se dá todo o seu processo judicial e os efeitos pessoais e patrimoniais que refletem nas partes envolvidas decorrentes da medida. Demonstram-se ainda as questões que mais repercutem discussões no cenário jurídico atual, fundamentando no princípio da afetividade a resposta às questões expostas. Por fim, aborda-se o tema principal: os motivos que levam o magistrado a dar preferência à ligação afetiva existente, assim como a consequência de sua inobservância. |
| Abstract: | The present work discusses the reasons and importance of prioritizing affective connection existing between adopter and adopting in the face of strict observance of the mandatory registration in the register of adoption brought by Law 12,010 of 2009 as a way to secure his right to family life and the priority of the interests of the child and adolescent. Justified by exceptional aspect of the subject which is treated adoption as well as the need to escape the controversy that's on the one hand the state ensure the right to family life against the principle of affection and obedience of the other requirements established by law. Search broadly pointing the arguments justifying the priority of affective bond existing between the applicant and the adoption adopter over the register established by Law 12,010 of 2009 and more specifically to a critical analysis of the law and the reasons for the creation of the register, showing the psychological and legal consequences of strict observance. The work was developed from the deductive method, where from an idea generally comes to a conclusion in particular, using the historical and comparative method, by documenting indirectly, related to the literature. First time all attempts to show the evolution of the institute, from antiquity to the present, showing the evolution of its concept and legal nature, according to the principles of informants Family Law. Soon after the treatment is evident that the legislation receives homeland with its characters and requirements for its grant, as well as gives your entire lawsuit and personal effects and property to reflect the parties arising from the measure. Show up the issues that still resonate more discussions on current legal scenario, basing on the principle of affective response to the questions posed. Finally, we discuss the main theme: the reasons why the magistrate to give preference to existing emotional connection as well as the consequences of its failure |
