Atuação do Ministério Público Estadual da Paraíba na concretização do Direito à saúde no município de Cajazeiras.

Abstract

The right to health is directly tied to the life quality so as its effectuation depends on the positive acting of the Public Power. Given this materialization context, the Public Ministry achieves relevance, especially with the current profile that the 1988’s Constitution gave to it, as a public interventional agent on the social reality to guarantee the full citizenship exercise and human person dignity. Thus, the present project seeks assess, in principle, the Public Power’s performance on the Town of Cajazeiras in the public health field comparing the local legislation and the objective reality with the most perceptible flaws, and specially note the Paraíba’s Public Ministry operation, during the 2012 year, from the used means to effect the right to health on the mentioned Town; pointing, finally, the Town’s public health reality with an effectiveness evaluation of the Parquet to make the right in analysis a real practice of the responsible management. To the achievement of the mentioned objectives, deductive approach methods are used, the historical procedures, monographic and structuralist and as research techniques the bibliographic and documental indirect. Note that there is wide legislation to govern the Town of Cajazeiras, however, there are failures on its materialization. In sequence measures the action means of the Town’s Parquet, in the health area, on the 2012 year, based on documental research in the institution, where there are registers of the used extrajudicial instruments. Stands out yet the Parquet’s efficiency level compared the municipal performance in public health.
