Abstract

The monograph will aim to understand the relationship between the principle of human dignity and failures in the Brazilian prison system for failing to fulfill its purpose which is the rehabilitation of prisoners and provide decent survival guaranteed by the Constitution and laws infra, turning what would resocialization in true crime. The uncertainties presented in the current context Brazilian penitentiary undertake a decisive role in the failure of the rehabilitation of inmates who are in their custody, as the sub-human conditions that are the same, which would be transformed into real criminal rehabilitation. The theoretical-methodological model adopted in this research was qualitative in nature, because in view of the importance of social concern surrounding the issue, this method is best suited to the goal to be achieved with the work. To do so, will be explored in this work issues related to how execution occurs and criminal reports some failures that negatively convicts re-enter society with satisfactory performance, because the prisoners are subjected to degrading conditions in Brazilian prisons. Therefore, it is important to analyze the reality and focus on Brazilian prison system if this is going to meet with the constitutional guarantees and brought in our criminal law, because society is immune from imagining such barbarity that exists in prisons is one that will suffer the greatest consequences of inefficiency, because the individual who passes through the system is unable to re-educate themselves and nurturing a sense of revolt, again to commit more atrocities when you leave prison. The prison system brings uncertainty about the fate of those who are under their custody, with the State to seek effective ways to change this reality.
