O aborto no Brasil: legislativo e movimento feminista: uma questão a ser discutida.

Abstract

This monograph is in the line of criminal policy, State and limitation of punitive power, because treat a criminal law, decriminalizing abortion tempting for the first three months of pregnancy and focusing the subject under the vision of women. Starting from the idea that the right to life is absolute and axiological is more important than other fundamental rights and, considering the principle of human dignity as the reference in the optimization of these rights is the abortion legitimate, since it is based on a system that combines term and indications. So, the behavior would not be punishable to the point of view of the mother, always considering the risks to maternal and fetal health. As a methodology, it used the literature search, the results achieved vision demonstrated that abortion is quite controversial because the influence is strong also of the right politicals and religions.
