???metadata.dc.description.resumo???:	Nos dias atuais a família tem relevante participação na ordem da sociedade e na regularidade das relações intersubjetivas, de maneira que diversos valores e normas nascem e incidem nestes tipos de relações. De outra forma, a análise acerca das configurações familiares existentes na normatividade jurídica, determina ao operador do Direito a compreensão de cada sujeito e os fenômenos que emergem no contexto social. Nesse passo, destaca-se a situação da alienação parental, que envolvem especialmente a figura dos filhos menores, atrelada geralmente, a uma mudança da estrutura familiar e a conduta dos genitores neste processo. Por este motivo, o presente estudo busca analisar a situação da alienação parental, frente à regulamentação de lei que trata sobre o assunto. O trabalho é sistematizado na exposição dos fundamentos da alienação parental e os traços gerais referentes às relações familiares, de forma a confluir seus elementos em harmonia ao problema levantado diante da responsabilidade porventura aplicada aos casos. Para construção do presente trabalho, a metodologia empregada será a de cunho dedutivo, através do estudo geral da responsabilidade civil e das novas formas de família, levando em consideração os efeitos gerados pela alienação parental. Para tanto, serão utilizados como métodos de procedimentos o histórico-evolutivo, a partir do estudo acerca da evolução do conceito de família e da responsabilidade civil, bem como o exegético-jurídico, na análise das proposições constitucionais e infraconstitucionais sobre a alienação parental. E como técnica de pesquisa será utilizada a documentação indireta, de cunho essencialmente bibliográfico, através da coleta das doutrinas nacionais e estrangeiras, como também de jurisprudências e periódicos que tratam acerca da temática, para a formação do referencial teórico a ser utilizado na construção de todo trabalho. Logo, o estudo não somente busca indicar os termos da responsabilidade aplicada aos genitores – ou outras pessoas em situação similar -, mas também o tratamento direcionado para a defesa dos jovens e crianças no campo familiar e social. Desta forma verifica-se a relevância da temática para a sociedade e o âmbito acadêmico para poder compreender as circunstâncias que envolvem a alienação parental.
Abstract:	Nowadays the family has significant participation in the order of society and the regularity of interpersonal relations, so that different values and norms are born and tackling these types of relationships. Otherwise, the analysis about the family configurations in existing legal normativity, the operator determines the right understanding of each subject and the phenomena that emerge in social context. In this step, there is the situation of parental alienation, especially involving the figure of minor children, usually linked to a change in family structure and behavior of the parents in this process. Therefore, this study seeks to analyze the situation of parental alienation, opposite regulation of law that deals with the subject. The work is the systematic exposition of the fundamentals of parental alienation and the general traits related to family relationships, so its elements converge in harmony to the problem raised before responsibility possibly applied to cases. For construction of the present work, the methodology will be the hallmark of deductive reasoning, through the study of general liability and new family forms, taking into account the effects generated by parental alienation. Therefore, methods will be used as the historical-evolutionary procedures, from the study of the evolution of the concept of family and civil liability, as well as the exegetical legal analysis of constitutional and infra propositions on parental alienation. And as research technique will be used indirect documentation, bibliographic essentially die, through the collection of domestic and foreign doctrines, as well as case law and journals that deal about the theme for the formation of the theoretical framework to be used in the construction of all work. Therefore, the study seeks to show not only the terms of liability applies to parents - or other people in a similar situation - but also the treatment directed to the protection of children and youth in family and social field. Thus there is the relevance of the theme to society and the academic sphere in order to understand the circumstances surrounding parental alienation.
