Abstract

This scientific research is the analysis of the scope of the salary cap, with respect to their impact on disability retirement benefits and maternity pay. The method used is the exegetical and legal nature, in order that we can achieve the necessary foundation for the elucidation of the problem that now appears. To clarify the legal debate and a better understanding of the topic, it is necessary, first, to approach the source of security in the world, until its adoption in Brazil, the Brazilian Social Security System structure, covering all existing benefits in Social Security. Subsequently, relate specifically about their own salary cap, its concept and the elements that are part of the calculation, namely: cost, principle of selectivity and distributivity and salary limits. That said, the intention of this work is to demonstrate the impact of this factor on disability pensions and maternity pay, sometimes drastically limiting the value of the benefits of workers who labored hard to ensure a dignified return, all through practical examples that will clarify the situation that they faced when applying their rights.
