dc.description.resumoA doutrina moderna confere aos direitos fundamentais um caráter irradiante, visto que tais direitos emanam valores para todo o ordenamento jurídico, não se restringindo às relações entre o Estado e os particulares. Diante desta justificativa emerge a eficácia horizontal dos direitos fundamentais. Devido à importância do tema no presente trabalho foi traçada uma evolução histórico-cultural dos direitos e garantias fundamentais, aprofundando-se na temática que envolve sua aplicação às relações privadas. Utilizando-se dos métodos: histórico-evolutivo, exegético, jurídico e técnica de pesquisa bibliográfica. Trazendo uma análise minuciosa das relações Estado-indivíduo (eficácia vertical), como também nas relações entre particulares (eficácia horizontal), o estudo em questão expõe as teorias existentes, e as já consolidadas, na ordem jurídica global. Quanto ao ordenamento jurídico brasileiro fundamenta-se o presente trabalho na doutrina pátria e alienígena destacando-se a alemã e a norte-americana, demonstrando sua origem e o atual estágio de evolução sobre o assunto; apontando para as novas tendências sobre a temática. Traçando também um panorama do posicionamento dos tribunais e da doutrina brasileira sobre eficácia horizontal dos direitos e garantias fundamentais. Demonstrando através de argumentos jurídicos convincentes qual teoria melhor se enquadra no ordenamento jurídico brasileiro.pt_BR

dc.description.abstractThe modern doctrine of fundamental rights gives a radiant character, since these rights derive values for the entire legal system, not restricted to relations between the State and individuals. Given this rationale emerges horizontal effectiveness of fundamental rights. Given the key theme in this paper was drawn a historical-cultural evolution of the fundamental rights and guarantees, deepening the issue involving its application to private relations. Using methods: historical evolution, exegetical, legal and technical literature. Bringing a thorough analysis of individual-state relations (vertical efficiency) but also in relations between individuals (horizontal efficiency), the study in question exposes the existing theories, and the already consolidated in the global legal order. As the Brazilian legal system is based on this work in doctrine and alien country with emphasis on german and north-american, showing their origin and the current stage of evolution on the subject; pointing to new trends on the subject. Mapping also an overview of the position of courts and the Brazilian doctrine on horizontal effectiveness of fundamental rights and guarantees. Demonstrating through compelling legal arguments which theory best fits the brazilian legal system.pt_BR
