dc.description.resumoAs alterações realizadas pelo Pacote Anticrime obtiveram destaque a partir do contexto pelo qual o Brasil se encontrava, primordialmente no âmbito político com a então recente mudança de governo. A promessa de fortes reprimendas e combate à criminalidade por parte da nova gestão no poder executivo no âmbito nacional, fazem jus ao momento em que ocorre a propositura do anteprojeto e demonstram nitidamente os objetivos de inserção de um sistema punitivo no ordenamento jurídico brasileiro. Consolidada então a intenção do poder executivo, o então Ministro Sérgio Moro, responsável pela pasta da Justiça e Segurança Pública realiza a proposta com as alterações a serem feitas em diversas legislações. O presente trabalho então tem como objetivo analisar como se deu o procedimento para inserção da nova Lei, suas alterações frente ao Código Penal Brasileiro e de que modo tal novidade na Legislação Penal pode afetar, positiva ou negativamente, e ser eficaz perante sua aplicação enquanto norma jurídica modificadora. Utilizando-se do método de abordagem dedutivo, realizando estudo e análise da Lei 13.964/2019 junto ao Código Penal, tendo como referencial teórico doutrinas penalistas, obras que tratam da temática em específico, bem como artigos científicos também sobre o assunto. O procedimento realizado teve o método exploratório para compreensão de cada uma das modificações trazidas para o ordenamento jurídico brasileiro, tendo como fonte de informação e embasamento para o trabalho a pesquisa bibliográfica. Diante disso, fora imprescindível a análise minuciosa dos artigos inseridos ou reformados pela nova Lei para que se obtivesse a certeza de que eles não cumprem com o que se objetiva enquanto contexto de alta criminalidade no Brasil. Ante os fatos, chega-se ao seguinte questionamento: A Lei no 13.964/2019, ao alterar o Código Penal, promoveu evolução e reproduzirá eficácia em sua aplicação? Sendo estabelecida a hipótese de que: Não se depreende absoluta evolução ou eficácia ao observar o que se modificou com a nova norma jurídica. É necessário ir além de reformas na legislação penal com o fim de penalizar cada vez mais.pt_BR

dc.description.abstractThe changes made by the Anti-Crime Package were highlighted from the context in which Brazil found itself, primarily in the political sphere with the then recent change of government. The promise of strong reprimands and fighting crime by the new management in the executive branch at the national level, right to the moment when the proposal of the draft occurs and demonstrate clearly the objectives of inserting a punitive system in the legal system Brazilian. The intention of the executive branch was then consolidated, then Minister Sérgio Moro, responsible for the Ministry of Justice and Public Security, carries out the proposal with the changes to be made in various legislations. The present work then has as objective to analyze how the procedure for the insertion of the new Law, its amendments to the Brazilian Penal Code and how such a novelty in the Criminal Law can affect, positively or negatively, and be effective in your application as a modifying legal norm. Using the method of deductive approach, conducting a study and analysis of Law 13.964/2019 with the Code Penal, having as theoretical reference penalist doctrines, works that deal with the theme in specific, as well as scientific articles also on the subject. O procedure performed had the exploratory method to understand each one. of the changes brought to the Brazilian legal system, having as source information and foundation for the work to bibliographic research. That said, a thorough analysis of the articles inserted or amended by the new law to ensure that they do not comply with objective as a context of high crime in Brazil. In view of the facts, one arrives at the following question: Law No. 13.964/2019, by amending the Penal Code, promoted evolution and will it reproduce effectiveness in its application? The hypothesis of that: It is not possible to infer absolute evolution or effectiveness when observing what has changed with the new legal norm. It is necessary to go beyond criminal law reforms with the end of penalizing more and more.pt_BR
