Negligência parental: A responsabilidade civil dos pais pelo abandono virtual das crianças e adolescentes.

Abstract

The present work has as its main objective and focus the study of family law, in relation to parental negligence, especially regarding the civil liability of parents for the virtual abandonment of children and adolescents. The research protects the greatest difficulties arising from the virtual abandonment of minors and the ways in which those responsible should be held accountable before the law. The methodology used in the elaboration of this study was bibliographic research, as well as the historical analysis of family relationships and the current legislation on the matter. This work was divided into three chapters. First, it will deal with the legal concept of family, its historical context and the rights and guarantees constitutionally guaranteed to children and adolescents. Then, virtual abandonment as a concept will be analyzed, discussing its guiding principles, the harmful impacts arising from parental neglect, the imposition of protective measures and the influence of the COVID-19 pandemic. And, finally, parental civil liability for virtual abandonment, the competence to judge these actions and the current position of the higher courts will be analyzed.
