| ???metadata.dc.description.resumo???: | O presente estudo tem como objetivo principal investigar a causa e os efeitos do reconhecimento da inconstitucionalidade da legítima defesa da honra pela ADPF 779. Para tanto, é necessário compreender as razões históricas e jurídicas que levaram ao referido veredito e analisar seus possíveis desdobramentos, a partir da análise do problema de pesquisa sob uma perspectiva histórica do tema e levantamento de considerações de juristas atuantes no tribunal do júri sobre a aplicação prática da decisão em estudo, de modo a relacionar a interpretação de acordo com os valores e princípios presentes na Constituição Federal de 1988 ao procedimento do júri em julgamentos de feminicídio. Referente ao aspecto metodológico da pesquisa, foram utilizadas a modalidade de pesquisa exploratória, técnicas de pesquisa bibliográfica e documental e coleta de dados por entrevista semiestruturada com juristas atuantes no tribunal do júri. Diante disso, verifica-se que, embora a sociedade se encontre em amadurecimento, ainda é necessário que a dogmática jurídica adote uma interpretação crítica das demandas sociais. |
| Abstract: | The main objective of this study is to investigate the cause and effects of recognizing the unconstitutionality of self-defense of honor by ADPF 779.To this end, it is necessary to understand the historical and legal reasons that led to this verdict and analyze its possible consequences, through the analysis of a historical overview on the subject and survey of considerations of jurists at the jury court on practical application of the decision under study, in order to relate the interpretation according to the values and principles present in the Federal Constitution of 1988 to the jury procedure in feminicide trials. Regarding the methodological aspect of the research, the exploratory research modality, bibliographic and documentary research techniques and data collection through semi-structured interviews with jurists working in the jury court were used.. Therefore, it is verified that, although society is maturing, it is still necessary for legal dogmatics to take a critical interpretation of social demands. |
