A aplicação do monitoramento eletrônico como forma de coibir a violência doméstica no Brasil.

Abstract

The Covid19 pandemic brought several consequences to society, among them, social isolation. With the quarantine, there was an increase in cases of violence against women in the home. In this context, the electronic monitoring system has also become a possible means of combating domestic violence. Thus, in order to guarantee the effective application of Law 11.340/06, a precautionary measure was implemented that decrees the use of electronic anklets for aggressors of vulnerable women. Therefore, the question that guided the development of this work is concentrated on the following issue: what has the system been doing to curb and eradicate this type of violence? Are there ways to avoid contact between the victim and the aggressor? These are some questions that form the basis of this research, and that do justice to an essential question: Does the democratic State really play its role in implementing the means of protecting women? The answers to these discussions are found in the course of this work, and soon, it will make the reader reflect on the subject of the explained thesis, whether or not it is a social problem. The present work aims to analyze the efficiency of electronic means of monitoring and its ways of curbing domestic and family violence, studying about domestic and family violence before the creation of the Maria da Penha law and observing the origin of law 11.340/2006 and the advancement of women's rights with its advent, considering the application of electronic monitoring as a means of preventing violence. As for the methodological approach, the research is descriptive and adopts the deductive method, starting from characteristics and general concepts to understand the legal progress in relation to the theme of domestic violence. In this perspective, the study shows many benefits from electronic monitoring, including independent projects from some states in Brazil to create efficient means of confronting violence. However, even with the evolution of protective measures in favor of women victims of domestic violence, there is still a need to advance other mechanisms, structure and studies for a definitive and permanent solution to the problem.
