Resumen:
This work aims to analyze the effectiveness of Law 11.340 / 2006 known as Lei
Maria da Penha (LMP). Within one of the main mechanisms of care for women in
situations of domestic violence in the city of Sousa / PB, the Specialized Police
Department of Women's Assistance (DEAM), in view of the attendance at the
institution, considering the progress since the enactment of this law and the
challenges to be overcome for its execution. When we report on the confrontation of
this violence, we highlight the struggle and participation of the feminist movements in
this historical conquest. Since its genesis the Feminist Movement has denounced the
inequalities between men and women and specifically the violence directed against
them, in this way, the force of these movements pressured the State for public
policies in favor of this segment, generating a greater visibility to the phenomenon
violence against the woman. It was from the 1980s that the struggles began for the
first policies aimed at combating domestic violence against women, which resulted in
the creation of the first DEAM in Brazil in 1985, but they did not always act in the
understanding of the gender category. With the advent of the LMP in 2006,
intervention for this type of crime has gained new functions. In view of this, the
research was carried out at the DEAM de Sousa / PB, with the purpose of knowing
the specificities of the Maria da Penha Law in the Municipality through a semistructured
questionnaire, through interviews with the professionals that make up this
institution. The results of the field survey revealed that with the arrival of the Maria da
Penha Law, there was progress in denouncing the victims of violence, in particular
the protection measures, but there is still resistance to the complaint due to the
absence of public policies for the women, that is, the opening of the State to provide
means for them not to be afraid to report.
