Abstract:
Society in recent years has evolved too fast, evidence of this are the innovations and technological advances that have emerged for some decades now, however, such advances were crucial to the development of crime, and then organizing it with this systematized and professionalized its means of production, making it difficult for the investigative bodies to investigate and resolve them. Through these changes, the State needed to reinvent itself in order to find ways of combating organized crime without being arbitrary. a Democratic State of Law, in this sense, the Legislative Branch created the current law to combat organized crime, Law 12,850 of 2013, which, in turn, disciplined the legal concept of organized crime and the means of obtaining evidence, among them the critical collaboration in persecutio criminis. In the wake of the contextualization presented, the choice of the theme of this study, which is characterized as an analysis, was encouraged by the recent scandals involving criminal organizations and the delinquency of their crimes, with the purpose of analyzing whether the institute of the awarded collaboration would be important for the resolution of complex crimes carried out by criminal organizations, managing to weaken them from the inside out. In this way, and using the deductive method and technical procedures of data collection and analysis, selection, reading and analysis of secondary sources, bibliographic research, documentary and descriptive research, it was possible to conclude by the effectiveness of the prize-winning collaboration in persecutio criminis without facing the right of the defendant and / or the collaborator.
