Resumo:
The work on screen is to examine the legality of the suspension in the supply of
electricity at the user's default. It is a matter of much relevance because it is part of
the daily life of every citizen to be modern and legal and doctrinal disagreements
about the topic of discussion. The idea of confection this scientific work arose from a
real case in which a lady who continually needed a breathing apparatus to survive,
was the supply of electrical energy suspended for non-payment, which caused his
death. Polls will be used doctrinaire and judgments. The problem of this work is
assigned the following question: to suspend the supply of electricity wounds, or not,
the principle of continuity? When public services are provided by concessionaires,
the principle of continuity should be followed so absolute? It will be dealt with the
structure of public administration and public services, the principles that govern, its
concept and its ratings, in particular the system of concessions. In a more
convincingly, will be made an evaluation on the suspension of the supply of
electricity, evaluating the applicability of Law 8.987/95 (law of concessions) or the
Code of Consumer Protection. Finally, from the arguments of the two positions
addressed, the author will examine the constitutionality and legality of the suspension
of the supply of electricity from its conclusions.
