Resumen:
Globalization as phenomenon of transformer trade relations in recent decades
functioned as na instrument for promoting the breaking of customs barriers imposed
by national sovereignty. Thus promoting the organization of a new world economic
orderbased on multilateralism endorsing drastic changes in the structure of
international trade competition. This scenario reflected in the liberalization of
domestic markets as well as the formation of regional economic blocs has footstool in
the multilateral trade rules, managed by the GATT and the WTO today. In this new
context of trade liberalization there is a nedd to stablish rules to protect competition.
That in the context of economic blocs such as Mercosur, includesan enviroment of
such importance to the consolidation of common space, integrated and harmonizing
therefore must combine the interests of economic agents to protect fair competition
and fair, removing the anti-dumping and compensatory measures, restricting the
scope for arbitrariness oftheir predation. There are the necessary institucional
organization of countries seeking protection policies whithout incurring penalities in
international arbitration. All this context is vital to the specific study of the problem of
this research, the policy under some what protectionist, established by Decree n°
7.567/2011 that the IPI major on cars not produced in Brazil, except those
manufactured in contries Mercosur and Mexico. This measure, a way to protect
competition in the defense of South American integration, since the exceptional
increase in the rate for countries that are not part of the Mercosur trade agreement,
enforcing the Protocol of Fortaleza, protecting the South American industry motorist.
