Resumo:
The organized crime is a world-wide event that has generated an increasing
integration between Brazil and other countries in the combat to this new form of
crime, as it occurred in the Convention of Palermo where Brazil ratified through
Legislative Decree measured of protection and control front to the criminal
organizations. Through writs of prevention and repressive, the present workmanship
aims at to ahead establish the legal parameters of performance of the Police
Authority of Intelligence of this criminal activity, exciting the exercise of practices on
the basis of derived from the controlled action made the delayed instant,
distinguishing itself from the prepared instant. The controlled action is foreseen in
Law 9,034/95 that it deals with the bonanza investigatory procedures that fight for the
punishment of these criminals. In this monographic work also the importance of the
figure of the infiltrated agent, its limits of performance by means of express judicial
authorization is boarded, which is foreseen in the incorporation. V, of Law 9,034/95
being added for Law 10,217/01, complementing the accomplishment of the controlled
action. With regard to the realizes of these tasks of inquiry the criminal and social
consequences will be analyzed, beyond the necessity of if distinguishing to have and
arbitraries, actions that are not confused clearly. Attributing to the necessity of one
better structure of the sector of police intelligence with the insertion of a national data
base, facilitating the cooperation it enters the policies of all Brazilian territory. All the
