The present work has for purpose to trace an analysis of the held special of Social welfare, that exercise your activities individually or in regime of family economy, aided in the Federal Constitution of 1988 and infraconstitutionaly, for the Laws n° 8.212/91 and 8.213/91. This species of having held that before they just had the protection of models attendance, like Funrural, they starts to have the covering it executes and universal of Social welfare, that established a differentiated regime of contribution and treatment different to the sparing to the others held of the General Regime of Social welfare. Therefore, the purpose of this research is to demonstrate the fetter faced for the held special in the proof of the quality of having held to obtain a benefit of the Social welfare, and to guarantee a life with dignity. The work is organized in three chapters, constituted by the use of the library methods, the historicalevolutionary and the interpretative-law. The benefits and services of the Social welfare granted to the held special, constituted by a public, in general very poor, that it was always out of the social conquests of the country, it assumes a paper of great importance for the promotion of the distribution of income and social justness, giving prestige to the beginning of the human person's dignity, and implementing significant changes, mainly, in the rural way.
