Résumé:
This work of completion of course examines the application and effectiveness of Law
No 11.340/06, known as Act Maria da Penha, which provided significant changes in
the legal system of the country, attributing effective penalties for practitioners of
family and domestic violence against women, who were before the sanction of the
law in question, confident that attacking women in the home was common and that
this fact was not criminal because they do not have a criminal law that the current
fought. The goal of this work is to highlight changes established by Law Maria da
Penha in Stations Specialized Defense of Women, with support provided assistance
of professionals trained in legal, psychosocial and health, enabling the woman victim
of domestic violence and family a refuge their needs and distress that this type of
violence provides, in order to be physical, sexual and moral, rehabilitating the victim
through measures for protection of urgency to ensure a fair and effective protection,
combating the aggressor and you attributing penalties for such acts. The aim is to
show that the company ask by measures that coibissem and prevenissem domestic
violence against women and family and that these species normative brought
advances necessary to prevent this kind of violence, because there was according to
statistical data, which there has been a growing demand of complaints made by
women victims of domestic violence and family who found safety in denouncing its
perpetrators believing that with the arrival of a specific law in its defense would not
have more need to hide their pain and anguish, but to drop it in form of complaint
since the law assists him that right. For which he witnessed during the search
corducted by the method exegetic legal, is that the law Maria da Penha provided a
rescue citizenship to women and their physical, mental and moral; profoundly
disrupted by years of waiting for a criminal law effective in their defense, no longer
considering the Family and Domestic Violence against women as a crime of lesser
potential, offensive where the punishment was referred to the aggressor in the form
of basic baskets. Law Maria da Penha besides ensuring proper assistance to women
victims of domestic violence and family, said that is accomplished international
agreements signed by Brazil against the discrimination and prejudice against women,
with the commitment not only of society, but also Powers of the Executive and
Judicial do happen to correct the law and eradicate this perverse form of violence
attributed to women in their scope domestic and family.
