Resumo:
The chaotic Brazilian penitentiary system faces a crisis in its main objective, the
rehabilitation. This fact is noted in the various prisons across the country.
However, before such a finding, the company has done little to demand
solutions from their leaders, which in turn, are not committed to change, really,
the current situation. The overall objective of this monograph is to show the
disparity between reality and the Brazilian prisoners texts of the Criminal
Sentencing Act and the federal Constitution, as Well as betting rules in
Resolution 14 of the National Council for Criminal and Penitentiary - focusing
particularly the rehabilitation. Presents specific objectives: to study the historical
recognition of sentences in prison and legal system; to analyze the systems and
the male prisons; but also show the points of inapplicability of the LEP and its
possible solutions. As a research method used the deductive, analyzing laws
and their application to reality prison. We use the method of procedure in the
analysis of the historical development of prisons and rehabilitation, thus using
documentary research and/or technical literature and documentation indirect.
There are state failures, especially health care, which simply separates the
criminal from society, leaving aside the process re-socialize the sentence. It
was concluded that lack commitment by governments and society in general,
the implementation of effective ways - such as education and labor - to build a
prison re-socialize.
