Resumo:
This scientific study is to discuss the causes of ineligibility, making a comparison between
Brazil and Guinea-Bissau. The research was guided by the following objectives: addressing
the Brazilian electoral system, introducing the concept, origin and historical electoral
principles, taking a long view of the Empire of Brazil, following the presentation of the same
within the first Constitution, and make the verification forms of vote allowed the people and
the limitations of citizenship to existing Federal Constitution, to analyze the electoral system
in Guinea-Bissau, showing the similarities and differences in electoral matters in that country
and Brazil, to evaluate the form of eligibility and ineligibility in Brazil and in Guinea-Bissau,
and perform a comparison between the Guinean and Brazilian electoral system, effectively
allowing an evaluation of such systems from an international viewpoint. The research consists
in theoretical terms, the works of renowned national scholars, law and information contained
in articles published in specialized websites. The scope of the proposed activity, appeared to
use appropriate methods of literature, exegetical and legal and collection of data is effected by
means of documentary research. It should be noted that the topic is relevant, considering that
is the center of discussions, making the activity of legislating contemporary Electoral Law.
Finally, the research, there was confirmation of the problem and the assumption made,
namely: problem - The causes of ineligibility available in Brazil are different from those
presented in Guinea-Bissau? Hypothesis: Yes, with a view that democracy in Guinea-Bissau
is something contemporary, and the Constitution of this country is still relatively weak over
the issue of ineligibility.
