Resumen:
The institute of educational measures provided for the ECA and applied to the teen
author of the infraction with disabilities or diagnosed with mental illness is configured
relevant issue against the current legal context, give rise to extensive discussions
arising from the lack of regulations and public policies that discipline the issue clearly
and objectively. On this track, through the present work aimed to analyze the
requirements of the rules governing such issues, especially the provisions of the
ECA, as the specific legislation to discipline the issues of children and adolescents.
To reach that goal, some procedures were employed. The method used was the
deductive approach, which consists of applying the principles, theories and more
general laws in the occurrence of particular phenomena, the method of procedure
was the monograph, so the topic fully and systematically, the research technique
adopted was the literature seeking to subsidies for the development of the subject
through the use of national and international books and papers of this thematic
approach. Given the research conducted it was observed the presence in the
Brazilian legal system with the core standards to regulate the subject matter,
relevant, also highlight the decisions of the patriotic courts in this sense, however the
current situation still gives rise to care and attention from authorities and agencies.
Thus, it appears that it intends to implement truly effective public policies with the aim
to implement the provisions of legislation.
