Résumé:
This article addresses the importance of the security and effectiveness of the Right to Health
to build a dignified and healthy life, whether physical or mental. In the 1988 Constitution
states that it is the duty of the state provide health protection, and is a citizen's right to have it.
Thus making each person is part of their dignity as human beings preserved. The reason this
research is given to the fact that today we can see the growing demand of the citizens the legal
remedies to obtain medical assistance or supply of drugs. The aim of this paper is to present
the importance of health for human life and the need for capable of effective applicability to
their individual well-being and mental health. Addresses as the research method-evolutionary
history to investigate the evolution of fundamental rights and its importance to building a
more just and egalitarian society, and the use of technical literature on virtual and the right to
health, his regime law and as applied in Brazil, and systematic information gathering. It
follows therefore that it is necessary that the agents of the state meet its constitutional
commitment, so that there is a responsibility regarding the protection and promotion of human
life
