Resumo:
This production examines the New Stage of Law, Law No. 11.788/08, from the
standpoint of their effects on employment relationships. His problem lies in the point
of showing the systematic regulation of the stage and thus seek to identify when and
how events will occur that will reach the field of labor relations, with their respective
consequences. The objective is characterized in exposing the Law 11 788 and the
main interpretations of its content, then study the problem from the perspective of
Brazilian law, notably under the parallel of the Labor Law. Therefore, the rationale of
this research is based on the brand new legal discipline on the issue stage, so there
is a need for a systematic knowledge about this novel legislation, in a practical way to
organize and characterize the relationship between training and employment. To
achieve this aspiration is largely adopts the method of interpretation of the law,
beyond the deductive method, and as the technical literature. Regarding the
legislation object of this research, it appears that it seeks to define and protect the
stage, especially as an extension of school learning, repudiating and punishing the
characterization of it as a cheap form of manpower. Another is the extraction of
productions doctrinaire on the subject. However, even concluding the legal
developments in the treatment of stage, should be considered faulty aspects of Law
11 788, which sometimes turned out to assign rights to different kinds of training, and
other times not discipline defense mechanisms and supervision of the same.
