Abstract

Scientific research has the scope main lodge a legal approach on the issue of domestic violence and analyze the innovations that have arisen in the country with the advent of the Law 11.340/06. For this work were used methods exegetic-legal and bibliography. Domestic violence is a serious problem faced by many women, and that, unfortunately, is hardly punished. Before the validity of said legislation, jurisdiction for the prosecution of this kind of crime was of Judgment Special Criminal where noted that the aggressors were benefited with the measures decriminalized the Law 9.099/95. This fact contributes to the impunity and for the recurrence. It appears that the legislated was consistent to finish in Article 41 of Law 11.340/06 remoteness of the competence of courts to try the crimes committed against women within families. It appears that the law in comment worsened the situation of the aggressors, because they will be punished so severely. Finally, it is observed that the law brings into your scope several programmatic standards, which determined that the Public Power unit and create mechanisms to support victims of domestic violence and family.
