Da efetivação do direito à cultura na cidade de Sousa: análise da política cultural implementada pelo Centro Cultural Banco do Nordeste - CCBNB.

Abstract

The right to culture is present in the Federal Constitution since its promulgation as a standard that demands the active position of the State in implementing the diffusion and protection of cultural property and heritage. In spite of cultural rights are recognized in the international arena as the second generation of fundamental rights along with social and economic rights, they never had the same prestige in the homeland legislation. At the federal level, there is in the last eight years a performance of the Executive Branch with the aim of boosting public instruments to encourage culture. This positive change was reflected also in the Legislative Branch that proposes to achieve and ensure the incentive of the cultural area. At regional level, we are witnessing a revival in the cultural scenery of the city of Sousa and region because of the inauguration of the Centro Cultural Banco do Nordeste-Sousa, which brought new opportunities for appreciation the northeastern culture to a population lacking of cultural elements. The overall objective of this work is to examine changes in the federal and regional authorities, and the implications of the social order of the effectiveness of cultural rights, based on the cultural politics of CCBNB-Sousa. For construction of the present study, we used deductive methods, exegetical-legal, literature research and method of field research to arrive at this result. On this porch, we seeks to highlight which ones social changes the effectuation of cultural rights can be achieved through the policy of encouraging the culture of the Banco do Nordeste in the city of Sousa-PB, as well as understand the relationship in common between the performance of CCBNB-Sousa and new understanding of the Brazilian legislative policy to encourage culture.
