Resumo:
In this work the author boarded the matter of judicial interference of the public politics of
health through an analysis concerning the countless judicial decisions that proliferate by the
whole country that interfere in the politics aforesaid having in mind the several controversies
that has been arising about the theme of this research, what it has been contributing to
generate a series of opposing points of view doctrinaire, juridical-legal, political, among other
about as it must be the effectiveness of the right to health. The main goals consist of
analyzing the conception of public politics, as well as right to health, besides showing the
intervention of the judiciary power in relation to the reason why so many referring judicial
decisions that treat about the mentioned right, the criticisms about to a possible excessive
interference and the favorable points to the performance of the judiciary power that
contribute for a real effectiveness of the right to health and about the need to find a balance
point by the judges when of the matters appreciation involving this kind of right that provoke
reflexes in the public health politics, so that to guarantee the right of those people that are hurt
and draw on judiciary power without damaging the right of the community.
