Resumo:
The theme of this work is the aesthetic damage, and legal significance of this
research, based on the importance of the institution of civil liability in respect of the
autonomy of the aesthetic damage. Thus, our objective is to demonstrate the
independence of the aesthetic damage in relation to moral damages. Thus
establishing the division of property damage and off-balance sheet, with a focus in
the latter, since it consists of the new damage, which, it fits the aesthetic damage.
Therefore, it is used in this study the method of deductive approach, as part of an
overall look for particular. The methodological approach is the historical-comparative,
because that makes a time-evolutionary approach, checking over the years the
evolution of object-related work. Already the research technique used is the
literature, beyond the collection of textual documents. Thus, this work is justified on
the idea that although there are discussions about the aesthetic damage and moral
damage, a few decades ago, both the doctrine and jurisprudence, fled to a more
precise definition, which will once and for all clarify whether there is independence
between the aesthetic damage and damage moral.Portanto, this research focuses on
understanding the idea of aesthetic damage in its general appearance, to emphasize
their autonomy, thus presenting one form of damage that leads to several
controversies by not being accepted by many scholars, and need more
