Résumé:
This work of completion of compulsory voting is voting and optional in the democratic
state. Aims to encourage discussion with focus on the examination of the theoretical
elements providing for the possible deployment of voluntary voting in Brazilian law.
The democratic state is based on principles such as popular sovereignty, democracy
and freedom. With support in freedom which develops democracy and voting is an
instrument par excellence of democracy should not suffer any restriction, because it
is a means for the exercise of popular sovereignty. So, the Brazilian legal system
must deploy the voting optional for the vote is in line with the principles of democracy
and democratic rule of law. The study of this work completion of course adopted the
method hermeneutic-legal for the analysis of the discussions about compulsory
voting, voting optional in a democratic state.
