Resumo:
The scientific research proposed here seeks to elucidate the presumption of discernment in the dispensation
of the employee with HIV virus, discussing the concession of stability
provisional. Thus, through theoretical study in the competent doctrine and pertinent legislation
aims to analyze the historical panorama of the disease pointing out scientific aspects about the virus
cause, the forms of transmission and treatments, relating it to the environment of
job. It also discusses scientific research on the guiding principles of labor law
work, the stability institute and existing labor standards, seeking to adapt the
central theme to the principles of the 1988 Federal Constitution of the preservation of dignity
and non-discrimination, in order to reveal the protection of the employee, person
economically weaker. not self-sufficient, against the economic power of the employer.
