Abstract:
The security factor is the theme of this scientific research, especially about its
incidence on the retirement age and contribution period benefits. The method used is
the legal-exegetical; this choice wants to reach the enough base for this elucidation.
First of all, this work boards the Brazilian social security system structure, inclusive
the facts that constitutes the security factor; this boarding wants to clear the debate.
After, it explains the security factor concept and its elements: age, life expectancy
and contribution time. Finally, this study focalizes the critiques about the security
factor, if it is constitutional or not, emphasizing about the vested right, expectation of
law and transition rules. Thus, the objective of this work is demonstrate, with real
examples, how unfair is the security factor incidence on age and contribution time
cases, because it decreases drastically the benefit value of people who worked hard
all life long to live a worthily old age.
