Resumo:
It is observed everyday in the vehicles of communication countless cases of
pedofilia, that bring devastating consequences in the children's lives and adolescents
victims of such actions. Before this fact, the legislator patrio created penal types to
punish and to prevent varied types of crimes related to the pedofilia, being foreseen
in the Penal code and in the Child's Statute and of the Adolescent. Referred them
legal diplomas passed for recent modifications that aimed at to combat with more
such rigidity practical than it violates the smallests' rights seriously. In this work, it is
looked for to verify the punitive legislation of the crimes related to the pedofilia is
being effective in the vision of the operators of the right, that you/they are close the
this reality, they are knowing of the penal norms, and they can analyze them in a
critical way. The present work used the inductive empiric method, being based in
field research, accomplished through the technique of the structured interview, with
questions pre-formulated professionals of the juridical area close to. It was still based
in the bibliographical research and documental analysis through the theoretical
reflection and of the method juridical hermeneutico. Along the research, they stand
out the general aspects of the pedofilia, the punitive legislation of the crimes related
to the pedofilia, and the effectiveness of the referred legislation. Due to the
presentation of the obtained data and uttered an analysis, it was ended that, for most
of the operators of the right, the punitive legislation of the crimes associated to the
pedofilia is not being effective.
