Resumen:
This work is about adoption by homoaffective couples, in Brazil, which is a very
controversial theme in methodological terms this can be classified as an exploratory
research, based on a survey of secondary die, thus characterizing a survey of
bibliographic and documentary purely The study approaches the institute the
adoption in Brazil, going through the laws which regulate it, including the Statute of
the Child and Adolescent which is a starting point whose major focus is the interest
and welfare of the minor.Although the Brazilian legislation does not contain any law
which regulates on families composed by homosexuals, this new familiar context is
increasingly present in our Brazilian society It must be also taken into account that
several institutions, created with the objective to defend the interests and rights of
this social group, have achieved important advances on the fight against prejudice
and discrimination which, unfortunately, still are present in society. In fact, this new
family context requires legal protection, and that their legal effects are recognized by
Brazilian law Therefore, work search aims to demonstrate that the adoption by
homoaffective couples is possible juridically speaking, as long as the legal
requirements the adoption process are fulfilled and the wish of starting a family
worthy is proved. This measure corresponds to the interests of unaided minors who
need affection and a home.
