Resumo:
This research deals with pedophilia practiced via the Internet and the lack of typing in
the Brazilian Penal Code. The objective of this work is to show the gap exists in the
field of criminal law regarding computer crime, but precisely pedophilia practiced via
the Internet. Since such a crime appears as a frontal attack on society. It uses to the
literature, the legal-exegetical method, the evolutionary and historical information
contained in articles published in specialized Internet sites systematize the study into
three chapters. The first chapter aims to address the historical aspects of pedophilia,
its concept, the issue of child sex of the person and their relationship with the victim;
and the third chapter attempts to show the liability of Internet providers face this
question, showing the means used to prosecute this crime committed through the
World Wide Web, and, thus revealing the factual situation of the lives of children and
adolescents in the World Regarding sexual abuse, looking for, so the means of
solution and repression, by a rule which explicitly defines his practice as a means of
preventing and punishing pedophiles. As a result of this study showed the absence of
specific criminal rule that addresses this issue by showing that the law is not keeping
the social and technological change at the same pace that they develop.
