Resumo:
It is worrying every day, increasing the number of children who are stealing their
innocence through sexual abuse by pedophiles. There are many ways of action and
characteristics of this type of criminal that is in most cases a person's family.
Because no definition of the crime in our legislation, despite much talk of rights of
children and adolescents, there is a discredit to the justice of society. Is important to
emphasize the many often irreparable consequences faced by a child who has
suffered some type of abuse of a child molester. The aim of this work is then to
demonstrate the importance of specific legislation for this type of crime, seeking a
better way of punishing offenders and preventing new cases. There is therefore a
need for further study by our legislators on these barbaric acts, thus adapting our law
to the historical and cultural presence that. Accordingly, the research shows the
different characteristics of a pedophile, revealing aspects of general and legal as it is
being treated as well as the relevant legislation matters. It is used to develop the use
of research methods: historical and evolutionary, directed the development of the
concept of pedophilia and the meaning of this expression, the method of comparative
study in order to set a parameter with the importance given to other crimes in order
Brazil and the legislation of other countries and finally the method exegetic-law, for
bringing the legal analysis on the subject. The methodology was applied in the study
of literature using a doctrine and law.
