Abstract:
The present work has the objective of analyzing the structure, effectiveness and efficiency in the settlement of disputes through conciliation within the Court of Justice of Paraíba, Sousa region, in order to verify its factual return to the population of this locality. Therefore, it seeks to analyze the history of the implementation of this conciliatory culture and of the Judicial Center for Conflict Resolution and Citizenship (CEJUSC), observing the sentences issued during the period in which this institute was inaugurated (June 2016 to June 2017). In this sense, the deductive method will be used, analyzing the impact of the promulgation of the new Code of Civil Procedure in the Court of Justice of Paraíba. The hermeneutic, comparative and structuralist method will also be used, analyzing free, articles, periodicals and other means of study that refer to the theme. Initially, it was presented the reasons why society and the Judiciary needed these alternative means of conflict resolution, highlighting the difficulty of access to justice, the crisis of the Judiciary and its eventual reform. Then, a study was made on the history of these alternative means in the Brazilian legislation and their concepts and their entry into the Brazilian legal order were detailed. Finally, the archives of the CEJUSCs and the Conciliation and Mediation Center of the Federal University of Campina Grande were analyzed to demonstrate the efficiency in the creation of this new culture of conflict resolution, bringing to the research its results and some recommendations that were observed According to the difficulties presented during the research.
