Resumo:
This monographic work aims to analyze in detail the causes of extinction of punishment, which are distributed throughout the Brazilian Penal Code, but in art. 107 of the aforementioned Penal Diploma are the most complex and the most common occurrence; As well as, theorize following a descriptive line, through a documentary research, collecting a larger number of data in order to consolidate all the content apprehended in the bibliographic research, providing the understanding and understanding of the procedural effects of the referred causes, and its application in practical situations. Throughout the text, the concepts of all causes that cause the extinction of punishment will be exposed, the moment in which each of them will be observed, the effect they produce, the limits of their scope, their characteristics, and also the diversity as to the nature legal of each one, being classified by the doctrine of the most varied forms, being able to be communicable or incommunicable, general or particular, natural or political, and emanate from legal facts or legal acts; Some are of a purely material nature, while others are of a formal nature, some will depend on simple legal acts, and others to consummate, will depend on the course of a certain period of time. The doctrinal and jurisprudential discussions on the topic under analysis will be raised with the transcription of the arguments and the reasons on which the supporters of each position are based, and then, the conclusion of the author and its consequent positioning based on the constant reading and understanding of the topic under analysis.
