Resumo:
The present work deals with a bibliographic study of the laws and research carried out by
Brazilian Justice bodies such as the CNJ (National Council of Justice), INFOPEN (National
Survey of Penitentiary Information) and CNMP (National Council of Public Prosecution)
analysis of the non-compliance with human rights when applying the Law of Criminal
Execution, observing custodial sentences. The aim is to study this subject in order to observe
the current prison system and only then be able to demonstrate that it is not possible to
efficiently comply under the human rights bias, which is intended for criminal execution,
where the principles that are guaranteed to the prisoners are not respected. grieving, violating
fundamental rights when fulfilling the sentence. If it tries to verify that the current system is
actually ineffective, and to present ways that make legal reality fit the reality of the victims,
and only then can the problem of prisoners who constantly go through situations of complete
abandonment of the competent authorities be solved. are always treated with disrespect, thus
showing the lack of interest in the search for solutions that lead to improve the current prison
system. Looking from the perspective of a main questioning, how does criminal enforcement
disrespect and violate the Human Rights of those who serve custodial sentences?
