The present monographic work establishes the theoretical conception of Parental Alienation and Parental Alienation Syndrome (SAP), addressing the characteristics, consequences and traumas resulting from them, aiming through a bibliographical research, to identify and analyze the incidence of SAP within families In a litigation situation, and after relying on the legal order and current legislation, Family Law, Civil Code, specific law and Federal Constitution of 1988, to indicate the responsibilities and legal consequences for the parent, custodian And cause of the parental alienation, being able to respond with payments of fines, inversion of the custody and possible civil responsibility. It was used the research to the works and academic productions, analyzing the theory, but allied always to the practical results, to which they served as starting point for the decision making and notes of attitudes that come to at least diminish the sequels left by the Syndrome of Parental Alienation. Using three poles for content analysis as well: the pre-analysis, the exploration of the proposed material and the treatment inherent in the results, thus producing the interference and interpretation necessary and so important for the research and the study, using Also as a bussola, the conceptual source provided by some professors, who further enriched the monographic work, and who in a masterly way contributed richly with his opinion about this pathology, called the Parental Alienation Syndrome. The analysis made in this research was based mainly on the work of Richard Alan Gardner (2002), which addresses a series of factors present in some families with separated parents, and is in a situation of litigation. Subsequently, it focuses on the concept of SAP, identifying its motivations, how it develops and what its possible and probable sequels are involved, especially the alienated children and points to the healthy relationship and contribution between Direct and Psychoanalysis, and the Benefits, breakthroughs and improvements that this interaction between the two branches brought. It also shows favorable results when the monitoring and treatment of the alienated and alienated are done correctly and when it counts on the direct and unified participation of the Public Power, Health System professionals, Justice, Education and especially the family, Which can ease the sequelae left by SAP, and avoid the incidence of new cases.
