Resumo:
In the financial recession scenario of recent years, the circumstances surrounding
gambling, which are considered illegal by the Criminal Offenses Act, are primarily
intertwined with the country's economic situation. Recent discussions about gambling
have a likely new source of funds for public safes. This monographic work addresses
the current situation of gambling in the national legal system, it is possible to legalize
the so-called illegal gambling and also the viability of collection with regulation. Aims
to analyze the possibility of revenue generation with the legalization of gambling,
focusing on the withdrawal of games of fortune from illegality. First, the history of
gambling and its representation in the country's legal order, in turn, the analysis as a
national social phenomenon, the monopoly exercised by the Union and also the state
Lotteries, like the LOTEP. Lastly, through the critical eye, the inefficiency of state
repression and the possibilities of collecting from the legalization of the practice in the
national territory, as well as the two main Law Projects on the subject in question, are
brought to light. The method that enables the monograph is the deductive and is
based on bibliographical research, subsidized by works of renowned professors, as
well as specialized articles published on Internet sites. It is understood that the
legalization of games of chance in the legal order of the country is an imperative fact,
both for the combat of the marginality that surrounds the practice, and the
establishment of a new source for the Treasury.
