Resumo:
Euthanasia is an intriguing theme and cause of controversy in our society. One issue
that deserves increasingly being discussed in view of the evolution of the right home
and the patients of incurable diseases agonize ill in their homes and beds in the
hospitals. Despite the controversy surrounding the issue it is already being practiced
by various peoples throughout the history of mankind. Euthanasia is characterized as
a death caused by an act committee, or omission of a person in his similar, which is
in a situation where their lives have no value, in the face of incurable illness and the
imminence of death, and scope and shorten the agony that comes from this evil.
Given the technological advances that occur each day, changing the mode of life of
society, it is necessary to demand such matters as: the euthanasia should be
legalized? This study aimed to: show all historical evolution of euthanasia; define
what is euthanasia, differentiate the suicido assisted, and the dysthanasia
mistanasia; discuss the positioning of our legal system on the issue and make
suggestions for implementation before the case. The methods used will be the
evolutionary history-and-exegetic in legal interpretation of some legal provisions. On
completion of the work it is argued by the favorable position regarding the practice of
euthanasia and assisted suicide as feasible, within the context of the principles of
freedom of choice and dignity.
