Abuso sexual contra criança e adolescente no meio intrafamiliar.

Abstract

Among the various forms of violence against children and adolescents, the violence experienced by those in the intrafamily environment are the more worrying because of this practice produce a discomfort as a result of not protecting the fundamental right of children and adolescents living with family, making them suffer anguish because of their vulnerability. Through historic and legal-exegetic methods and literature search it was concluded that this type of violence which is the sexual abuse as intrafamily is frequent and involves a sexual activity between a child or adolescent and a immediate member of the family or a close one. This form of abuse is a manifestation of family dysfunction and tends to be chronic, recidivistic and without violence, as the aggressor uses its position of authority and blackmails the victim to obtain its consent and posterior silence. In formulating this essay was tried to understand how even today, in front of a society in a globalized world, with widest possible access to information, even cannot protect their children and adolescents. They are citizens who have, even without voice, leaving a situation where they were seen as "minor", "delinquent", managed to break with the doctrine of irregular situation and move to be subjects of rights rather than objects of rights, guaranteed by Doctrine of Integral Protection explicit in both the Federal Constitution of 1998 as the Statute of the Child and Adolescent, and also in other international documents aimed at the protection of children and youth. Unfortunately this kind of violence comes spreading since ancient times and is still in daily use, at the side of the house of each one, where there is a sexually abused child or adolescent by the people who should protect, but rather are violating an entire development of an individual, changing from a brutal way all his life, because the consequences left by this type of violence are extremely serious. Legal provisions exist, prevention programs and combat exist, but the legal order and public organs fail, thus requiring the support of society for this sexual violence committed within the family will not go unpunished.
