Resumen:
The present work has the objective prime to make a primary study about the municipalization
of social educative measures amid open in the city of Sousa. It is observed that the Statute of
the Child and Adolescent (Federal Law no. 8.069/90) by adopting the doctrine of full
protection legislation led to children and youth, with children and adolescents treated
consistent with the condition of peculiar person in development of personality. Under this
new security perspective, the ECA has brought in its midst social educative measures whose
aim is re-educate and allow social life again to the adolescent in conflict with the law. Among
these measures there are several half-open, which are non-custodial, which guarantee the
resocialization of adolescents, within Family and Community, featuring lower rates of
recidivism. Aiming to ensure the proper implementation of the middle open and unify the
procedure, one of the exits found is the municipalization of care through the creation and
maintenance of programs that preserve the fundamental rights of children and youth
population. The municipalization it is also a strategy that seeks to reverse the trend of growing
national hospitalization of adolescents, because we observed that the increase in the severity
of the measures have not worked for social inclusion of adolescents, especially the graduates
of the private system of freedom. From the present research,it was found that the council de
Sousa has not yet adopted the decentralization process of care childcare amid open, although
the city already has the appropriate structure and skilled personnel to implement this process,
given the lack of political will to implement them.
